Driving Under The Influence
The penalties for a first DUI include mandatory sanctions: These include:
- Probation for 12 months,
- 50 community service hours,
- Alcohol evaluation and any treatment,
- Vehicle impound for 10 days,
- Suspension of Drivers license for six months.
The Florida DUI penalty for a second DUI conviction depends on two factors:
- If this second DUI “arrest” occurred within five years of the first “conviction” and
- Whether the BAC was over a .15 or there was a minor in the car.
If the Second DUI occurred within five years of the last conviction, then the penalties include:
- Mandatory 10 days in jail,
- Mandatory 5 year license suspension,
- Mandatory one year probation
