Driving Under The Influence

The penalties for a first DUI include mandatory sanctions: These include:

  • Probation for 12 months,
  •  50 community service hours,
  • Alcohol evaluation and any treatment,
  • Vehicle impound for 10 days,
  • Suspension of Drivers license for six months.

 

 

The Florida DUI penalty for a second DUI conviction depends on two factors:

  1. If this second DUI “arrest” occurred within five years of the first “conviction”    and
  2. Whether the BAC was over a .15 or there was a minor in the car.

If the Second DUI occurred within five years of the last conviction, then the penalties include:

  • Mandatory 10 days in jail,
  • Mandatory 5 year license suspension,
  • Mandatory one year probation
  • Court costs and fines
